Pertikaian antara pemilik jenama Lotus iaitu Proton dengan pasukan lumba Lotus Racing/Team Lotus masih belum menampakkan kesudahannya.. masing2 saling mempertahankan hak mereka ke atas nama tersebut.. di pihak Lotus & Proton mereka mengatakan penggunaan jenama Team Lotus adalah hak mereka & mungkin penggunaan nama itu akan menjejaskan reputasi jenama tersebut , manakala bagi pihak yang sebaliknya mengatakan Lotus & Proton tiada kaitan dengan nama tersebut yang mereka beli daripada Lotus Ventures Ltd yang merupakan pemilik asal Team Lotus. Sampai bila pertikaian ini akan berlarutan? Apa yang pasti mereka mempunyai sebab2 yang kukuh demi menjaga kepentingan masing2..

PROTON’S CLARIFICATION ON THE PURCHASE OF “LOTUS” BRAND BY TONY FERNANDES

Kuala Lumpur, 27 September 2010 – There is and always has been only one Lotus, the Lotus started by Colin Chapman. From the beginning Lotus made road cars and raced racing cars. Until 1994, Group Lotus, the road car
manufacturer and Team Lotus, which operated the Formula 1 team, were in common ownership with common directors. In 1994, Team Lotus failed and Lotus has not raced since. Since 1994, David Hunt has claimed to have
acquired assets of Team Lotus, including its name, from the liquidator. He has never raced as Lotus. Mr. Hunt’s attempt to acquire the name TeamLotus was ineffective. Group Lotus is the owner of all rights in the “Lotus” automotive brand including those relating to Formula 1.

Last year, Tony Fernandes and 1 Malaysia Racing Team recognised this by taking a licence from Group Lotus to use the “Lotus” brand for the “Lotus Racing” team in the current Formula 1 season. With PROTON’s agreement, Group Lotus has now terminated its licence to 1 Malaysia Racing Team to use the “Lotus Racing” brand in the 2011 and future Formula 1 seasons as a result of the flagrant and persistent breaches of the licence by 1 Malaysia Racing Team, which were damaging to the “Lotus” brand.

Following that termination, neither 1 Malaysia Racing Team, nor any other company associated with Mr. Fernandes such as Tune Group Sdn Bhd or Team Lotus Ventures Limited, has the authority of Group Lotus to use any “Lotus” brand in the 2011 Formula 1 season. This includes the use of the brand “Team Lotus”.

Group Lotus understands that Mr. Fernandes intends to rebrand the current “Lotus Racing” Formula 1 team to “Team Lotus” for the 2011 Formula 1 season. Mr. Fernandes indicates that Tune Group has acquired the rights to the name “Team Lotus” from a business formerly owned by David Hunt called Team Lotus Ventures Limited. Group Lotus believes these rights to have no proper legal foundation, a fact of which Mr. Fernandes was well aware when his company purchased them.

PROTON will support Group Lotus in taking all necessary steps to protect its rights in the “Lotus” name, including resisting any attempts by Mr. Fernandes or his companies, or any other unauthorised person, to use the “Lotus” name in the 2011 Formula 1 season.

Dato’ Sri Mohd. Nadzmi Mohd. Salleh, Chairman of PROTON Holdings Berhad and Group Lotus commented, “We believe the Lotus brand to be one of the most valuable brands in Formula 1 today. We are the owners of this brand, and will take all necessary steps to protect it. Tony Fernandes has no rights to use the Lotus brand in the 2011 Formula 1 season, and we will strongly resist any attempts by him to use our brand without our permission and will withdraw our sponsorship of the Lotus Racing team.”

“To put it simply, Group Lotus is everything Lotus. The fact that 1 Malaysia Racing Team entered into an agreement with Group Lotus to use the brand means that both Mr. Fernandes and 1 Malaysia Racing Team recognises and acknowledges Group Lotus’ rights,” he added.

  1. Lotus Tony Fernandez tu bukan Lotus sebenarnya… sebab dia bukan guna enjin Lotus atau pun kereta Lotus… cuma logo je Lotus.. so Lotus ke tu??!

    Kalau aku tiba-tiba masuk F1 pastu bagi nama kereta aku Team Ferrari, padahal takde satu pun enjin/kereta ferrari aku pakai.. boleh ke?

    • tak silap sy nama pasukan asal Lotus Racing tu sebenarnya Litespeed racing..lepas Tony ambil alih pasukan tu diorg minta lesen penggunaan nama Lotus dari Proton & Proton juga salah 1 daripada penajanya.. pasukan tu based je kat UK, tapi crew2 dia bukan dari Lotus pun..nape lah Tony ni nak juga nama Lotus tu sedangkan dia boleh sangat nak namakan team tu AirAsia racing macam seterunya Virgin racing..mungkin ada perkara yg buatkan dia nak sangat dengan nama Lotus, dulu dia pernah cakap berminat nak beli Lotus kalau Proton nak jual, tapi jangan harap la.. 🙂

  2. Kesudahannya senang aje. Kalah jadi arang, menang jadi abu. Yang untung adalah lawyer dan kerajaan British sebab kes ni Tony Fernandes dah failkan di mahkamah UK, dan bukannya Mahkamah di Jalan Duta. Tune Group tak patut buat macam ni. Tahun 2010 dia minta izin dengan proton melalui Pm nak guna nama Lotus racing, tapi 2011 dia beli pula nama Team Lotus dan nak independence. Penggunaan nama Lotus racing daripada proton itu sendiri menunjukkan yang Tony Fernandes ni sedar yang nama Lotus adalah milik Proton (Nama Lotus ni terpakai untuk kegiatan automotif sahaja).

  3. im with proton on this dan tony tu cuba mainkan keadaan utk keuntungan nya, bg sy seharusnya if nama lotus di gunakan utk race f1 ini seharusnya juga mengunakan kepakaran mereka 100% sperti tahun terdahulu dan tidak bergantung pada engine or kepakaran dari team lain. jikalau masih tidak mampu sekarang, so betul lah tindakan proton itu. kekalahan akan memalukan branding proton juga dan lotus group.

  5. Kalau tak silap saya, Proton bagi kebenaran penggunaan nama lotus dulu sebab atas sebab patriotik, ada nama Malaysia. Sekarang ni bila keadaan dah berubah, bermakna Tony and the geng dah langgar perjanjian dan persetujuan dulu, jadi sebab tu la Proton keluarkan kenyataan supaya branding Lotus tu Tony tak boleh guna.

    Tony ni pulak kaki bisnes, dia orang akan guna duit dan apa saja untuk mencapai cita-cita dia orang. Sepatutnya Tony tak boleh langgar perjanjian dulu, walaupun perjanjian tu atas dasar sesama syarikat malaysia, Tony tetap kena ikut. Dia kena terima hakikat yang Lotus hak mutlak Proton, kalau dia nak guna jugak perlu ada justifikasi yang kukuh.

    Saya dah terima email dari Proton dan penjelasan yang Proton berikan tu memang tepat, jenama Lotus adalah hak mutlak Proton dan orang lain tak boleh guna jenama tu kecuali dengan kebenaran Proton.

    Dah terang2 Lotus Group di bawah proton tu terbahagi kepada 3; Lotus Cars, Lotus Engineering dan Lotus Team Venture (LTV). Kenapa si tony tu terus deal dgn David hunt (lotus team venture ltd) tu atas urusan jual beli dgn membelakangkan proton? Sbb dia tau kalau melalui proton, mana proton nak kasi.

    Kalau mcm tu lepas nie kalau ada projek(cth buat company sub brand ker) bagi jer lesen brand lotus kat sesape. Pastu yg sesape tu bleh deal terus dgn pemilik asal lotus cars ker atas urusan jual beli, pastu tukar nama. dah jadi company lain. Pandai2.

    dlm kes nie, saya percaya proton di pihak yg benar. Tony F bijak manipulate kerajaan dgn tema 1malaysia memperdaya proton memberikan lesen utk bersaing dlm F1. Proton berikan hak guna pakai brand lagenda lotus itu atas dasar perjanjian bersama proton n 3 otai (air asia n naza) utk perlumbaan F1 sahaja. Rupa2nya tony n the gang ada maltamat yg lebih besar lagi. Dgn membeli lotus team Venture ltd, diorang dah bleh buat/jual product dan ini bertentngan dgn perjanjian asal mereka dgn proton. … haiyo, talak baik ar ini mcm… ini mcm meniaga ala busut ooo….

    • tu belum cerita pasal dia paksa kerajaan buat LCCT dulu utk Air Asia..dia ni pandai manipulate keadaan..belit banyak kuat, smpai ada yg terbelit..hehehe…tp strategi branding dia memang berjaya, boleh diiktiraf sebagai pakar dlm bidang ni.. 🙂

  13. Menyampah betul dengan dia ni, sekarang dah cakap besar dulu pun kerajaan tolong biar dia operate dari airport subang , MAS dah kena pindah sepang. Masa tu lah dia build up nama dia. Sekarang cakap kepala dia beruban lah pasal govt asyik back GLC (MAS).
    cukai dia mengelat nak bayar MAB. Tony u pun pakai tongkatlah.

    Nazir’s views were echoed by Air Asia CEO Datuk Seri Tony Fernandes.

    “Government should get out of business. That would make us all much happier,” the outspoken budget airline tycoon said.

    Fernandes stressed that it was important for a level-playing field to be created to allow all Malaysian companies to excel regardless of whether or not they were government-linked.

    “Holding one back is not the way forward,” he said.

    He explained that Air Asia X had to cut back billions in investment due to protectionist measures restricting profitable routes when the long-distance carrier should really be given the same opportunities as GLC Malaysia Airlines to spur expansion in the tourism sector.

    “This is a real test… to see how the government and Pemandu react to the aviation area so that both (carriers) can succeed and both can contribute to the growth of the national economy.”

    He said the government must learn to see itself as purely an enabler so that it did not feel compelled to protect GLCs by holding back private companies.
